As part of strengthening the principles of transparency and accountability, improving the management of public services, increasing public participation in the development, monitoring of implementation, and evaluation of public policies, and strengthening trust between organizations subject to the provisions of the Law, individuals and legal entities, and civil society organizations, Article 32 of the Tunisian Constitution enshrines the right of access to information as a constitutional right whose exercise is guaranteed by the State. Furthermore, Organic Law No. 2016-22 of March 24, 2016, on the right of access to information, sets out the implementing measures and related procedures.
Access to information
Thus, access to information is provided either through the proactive publication of information by the organization concerned and the right to access it upon request in accordance with sections 6, 7, and 8 of the Act, or through any natural or legal person who submits a written request for access to information in accordance with a pre-established template made available to the public by the organization (document available for download).
The information access officer is responsible for receiving requests for access to information, processing them, and responding to them within the specified time limits.
An applicant for access to information who is dissatisfied with the decision made regarding their request may file an informal appeal with the head of the organization concerned within twenty (20) days of notification of the decision. The head of the organization is required to respond as soon as possible, provided that the response is not later than ten (10) days from the date the request for review was filed.
If the head of the organization concerned does not respond within this period, the request is deemed to have been refused. The person requesting access to information may appeal directly to the access to information authority.
